Pentyl Labs Terms and Conditions

1. Scope of Services

Pentyl Labs provides analytical testing and reporting services for cosmetic and consumer products. Services are limited strictly to the specific tests requested and agreed in writing. No services beyond the defined scope are provided unless explicitly confirmed in writing.


2. Sample Responsibility

Results apply only to the specific sample or samples submitted and tested.
The client is solely responsible for sample identity, formulation accuracy, labeling, and representativeness of the material submitted.

Pentyl Labs does not verify composition, homogeneity, or batch consistency unless explicitly included in the scope of work.


3. Testing Limitations

Analytical results reflect conditions at the time of testing only.
Results may vary due to formulation differences, batch variability, storage conditions, aging, or handling.

Testing is limited to the specific parameters requested.
Targeted or screening analyses do not represent a comprehensive evaluation of all possible substances, contaminants, or risks.


4. Flash Point and Physical Testing Disclaimer

Flash point and related physical property results are determined using standardized methods under controlled laboratory conditions.
Results may vary depending on formulation differences, sample preparation, and test conditions.

Such results do not guarantee product behavior under all real world storage, transport, or use conditions.


5. Targeted Chemical Testing

Testing for specific compounds, including but not limited to PFAS, 1,4 dioxane, or other analytes, is limited to the defined method scope.

A non detect or compliant result does not indicate the absence of all related substances or contaminants outside the scope of testing.


6. Interpretation of Results

Unless explicitly stated in writing, Pentyl Labs does not provide safety determinations, toxicological evaluations, or regulatory approvals.

Test results should not be interpreted as confirmation that a product is safe, compliant, or suitable for market.


7. Client Decision Responsibility

All decisions regarding formulation, manufacturing, labeling, regulatory compliance, marketing, and product release remain the sole responsibility of the client.

Pentyl Labs shall not be responsible for actions taken based on test results or reports.


8. Subcontracted Testing

Pentyl Labs may utilize qualified third party laboratories to perform certain analyses.

While reputable partners are selected, Pentyl Labs does not control all aspects of third party operations.
Results generated by subcontracted laboratories are reported as received and are subject to the methods, limitations, and quality systems of those laboratories.


9. Use and Reproduction of Reports

Reports must be used in their entirety and may not be altered, excerpted, or selectively presented.

Reports may not be reproduced, distributed, or used for marketing purposes without written consent from Pentyl Labs.


10. Payment Terms

Services may require prepayment or deposit.
Pentyl Labs reserves the right to withhold reports until payment is received in full.


11. Sample Retention

Samples may be retained for a limited period unless otherwise agreed.
Pentyl Labs is not responsible for sample stability or degradation during storage.


12. Confidentiality

Client information and test results are treated as confidential unless disclosure is required by law or authorized by the client.


13. Limitation of Liability

To the fullest extent permitted by law, Pentyl Labs total liability for any claim arising from services shall be limited to the amount paid for those services.

Pentyl Labs shall not be liable for indirect, incidental, or consequential damages, including loss of business, revenue, or reputation.


14. Indemnification

The client agrees to indemnify and hold harmless Pentyl Labs from claims arising from product formulation, manufacturing, labeling, distribution, or use of the product.


15. Claims Period

Any claim must be brought within twelve months of the date of report issuance.


16. Governing Law

These terms are governed by the laws of the State of New Jersey.
